When Do You Need to File in Another State?

Just because Florida has no income tax doesn't mean you're off the hook everywhere. Here's when state returns are required.

Remote Workers

Work remotely for a company based in another state? Some states require you to file there — even if you never set foot in the office.

You Moved During the Year

If you moved from another state to Florida (or vice versa) mid-year, you may need to file a part-year return in both states.

Rental Property in Other States

Own a rental property in Georgia, North Carolina, or elsewhere? Most states require non-residents to file returns for in-state rental income.

Business Operations Across States

Operating your business in multiple states? You may have nexus and income tax filing obligations in each state where you operate.

Investment Income from Other States

Income from partnerships, S-Corps, trusts, or other pass-through entities located in other states often requires state-level filing.

Worked Temporarily in Another State

Did you travel for work and earn income in another state? Many states have low income thresholds that trigger a filing requirement.

Frequently Asked Questions — State Tax Filing

Does Florida have a state income tax?

No — Florida is one of nine states with no personal income tax. However, if you earn income in other states, work remotely for an out-of-state employer, or own property in states that do have income taxes, you may still owe state taxes elsewhere. We help you understand exactly where you owe.

I work remotely for a company in New York. Do I owe New York taxes?

Possibly. New York uses a 'convenience of the employer' rule, meaning if you work from home for convenience (not necessity), your income may still be taxable in New York. Several other states have similar rules. This is one of the most common issues for remote workers today.

I moved from California to Florida mid-year. Do I still owe California taxes?

Yes, you will likely owe California taxes on income earned while you were a California resident. California also aggressively pursues former residents, especially those with stock options or deferred income. We prepare your California part-year return and help you establish clean residency in Florida.

What is a part-year resident return?

A part-year resident return is required when you live in a state for only part of the year. You'll report income earned while a resident of each state separately. We handle all the allocation calculations so you don't pay more than you owe in either state.

Can I get credit for taxes I paid in another state?

In most cases, yes. Most states offer a credit for taxes paid to other states on the same income to avoid double taxation. However, the rules vary significantly by state and not all reciprocal tax agreements apply to all situations. We optimize these credits to minimize your total state tax burden.

I own a rental property in Georgia. Do I need to file there?

Yes. Georgia and virtually every other state require non-residents to file a state return if they earn rental or business income from property located within the state. We prepare these non-resident returns for all states where you have property or business income.

What states have no income tax?

As of 2024, nine states have no personal income tax: Florida, Texas, Nevada, Washington, Wyoming, Alaska, South Dakota, Tennessee (on wages), and New Hampshire (on wages). If you live in one of these states but work or invest in others, you may still owe taxes in those other states.

How far back can states audit me for unfiled returns?

Unlike the IRS, which generally has a 3-year statute of limitations, many states have no statute of limitations on unfiled returns — meaning they can pursue you indefinitely. If you have unfiled state returns, it's important to get into compliance as soon as possible before penalties accumulate further.
